      Beginning early next year, drivers in New York should brace for stricter regulations, as the state modifies its driver points system and raises penalties for various traffic violations.

      The aim is to curb reckless behavior on the roads, although the uniformity of enforcement will largely rely on local policies. Research indicates that traffic enforcement has not yet returned to pre-pandemic levels, which may affect consistent implementation.

      What’s Changing?

      The most notable adjustment relates to the number of points a driver can accumulate before facing suspension. Currently, drivers who collect 11 or more points within an 18-month timeframe risk losing their license. Next year, that limit will decrease to 10 points over 24 months, requiring drivers to maintain better behavior for longer periods.

      The point values for certain violations have also been adjusted. For instance, being caught speeding 10 mph over the limit will soon result in 4 points instead of the current 3.

      Additionally, drivers using their phone while driving will receive an immediate 6-point penalty, up from 5. The penalty for failure to yield to a pedestrian has increased from 3 to 5 points, while reckless driving now carries a penalty of 8 points, up from 5.

      Moreover, drivers who illegally pass a stopped school bus will incur 8 points immediately, a consequence that can quickly lead to license suspension. The same 8 points will be applied to anyone speeding through a construction zone, regardless of how much over the limit they go, according to News10.

      Stricter Penalties

      Several other traffic violations now also risk point deductions. New Yorkers could lose 2 points instantly for making an illegal U-turn or for obstructing traffic. Not yielding to an emergency vehicle will result in a 3-point penalty, while equipment violations will now incur a 1-point penalty.

      Local authorities have also altered their approach to repeat offenders driving under the influence. Drivers with four or more DWI convictions can now have their licenses permanently revoked, a change that is widely seen as beneficial.

      According to The New York Times, traffic enforcement in New York sharply declined during the COVID-19 pandemic and has not fully rebounded in many areas.

      Whether police departments will actively enforce these tougher standards remains uncertain, but it is clear that the margin for error on New York’s roads is set to decrease significantly.
