
Cybertruck Owners File Lawsuit After Costly Upgrade Was Delivered Lacking Its Key Feature | Carscoops
An owner claims he never received the light bar, despite paying a $20,000 premium for the Foundation Series model.
Shoppers who ordered a Foundation Series were expected to receive several accessories. The main feature of the package was an off-road light bar affixed above the windshield.
A lawsuit alleges that Tesla knowingly advertised features it never intended to provide.
When Tesla introduced the Foundation Series version of the Cybertruck, it included a promise of a special roof-mounted LED off-road light bar. However, a recently filed lawsuit in the US states that numerous owners did not receive these light bars, and some may not have purchased their trucks had they known the light bar would not be included.
The lawsuit was brought by plaintiff Eric Schwartz in California. He claims he bought a Tesla Cybertruck Cyberbeast in December 2023, paying an additional $20,000 for the Foundation Series version. These vehicles were meant to come with multiple enhancements, including the light bar positioned above the windshield.
However, according to Schwartz, his Cybertruck was delivered without the LED light bar, and despite multiple attempts to contact the automaker, he asserts that it has refused to provide it.
The lawsuit argues that the plaintiff has experienced an 'injury in fact' because Tesla accepted his payment without delivering the promised products. Through this class action, Schwartz seeks to represent all Cybertruck buyers in California who purchased a model that was meant to include the off-road light bar but did not receive it.
The class action also suggests that buyers might have chosen not to purchase their Cybertrucks had they known Tesla was advertising the light bars without the intention of including them with the vehicles.
This is not the only recent lawsuit against Tesla in California. Earlier this week, U.S. District Judge Rita Lin stated that the automaker must respond to a certified class action that accuses it of misleading drivers regarding the self-driving capabilities of its vehicles. This lawsuit asserts that Tesla fell short of the promises made by the company on its website, in blog posts, on social media, and in remarks made by CEO Elon Musk.
