
Mercedes Owners File Lawsuit Due to Cracked Wood Trim in Luxury SUVs | Carscoops

Mercedes is facing legal action over accusations of cracking wood trim in luxury SUVs manufactured between 2013 and 2022.
One of the plaintiffs claims a dealer informed her that replacing the veneer would exceed $1,000.
While a judge has rejected some claims, the lawsuit persists in its pursuit of damages and a trial by jury.
Do you own a Mercedes-Benz from 2013 to 2022 with wooden trim that appears damaged? If so, you might want to know that Mercedes is being sued for wood trim pieces that are said to crack over time, leading owners to incur costly repairs.
The class action lawsuit, submitted in the U.S. District Court for the Northern District of Georgia, encompasses all Mercedes-Benz ML, GL, GLE, GLS, GLC, and GLK models from the specified years. It alleges that the automaker violated implied warranties by selling vehicles with veneer wood trim that is susceptible to cracking and accuses Mercedes of knowingly hiding the defect.
Owners have reported unforeseen repair expenses.
One plaintiff, Jennifer Monilaw, acquired a 2013 GL in July 2019 from an authorized Mercedes dealer. However, she noticed the veneer trim began to crack in late 2020 and learned from a dealer that it would not be covered by warranty. The dealer also indicated that replacing the trim would be costly.
Another plaintiff, Shannyn Burzese, faced similar problems with her 2016 Mercedes GL. After the trim cracked, a dealer told her it would cost more than $1,000 to replace. The lawsuit claims that the affected vehicles are now “not merchantable” due to the cosmetic and financial repercussions of the issue.
According to CarComplaint, Mercedes-Benz has attempted to have the entire lawsuit dismissed but has not been successful. However, Judge Thomas W. Thrash Jr. has dismissed several claims from the initial class action, including breach of express warranty, breach of implied warranty, violation of the Magnuson-Moss Warranty Act, and unjust enrichment.
The class action is currently seeking a jury trial, in addition to compensatory and punitive damages for the impacted owners.
